Matthew Clayton

Matthew is an experienced solicitor who specialises in dealing with claims involving injuries of the utmost severity. A member of BABICM (The British Association of Brain Injury Case Managers), APIL (Association of Personal Injury Lawyers) and SIA (Spinal Injuries Association), he has particular expertise in brain, spinal injury and amputation claims. He has secured many settlements for clients in excess of £1 million, with notable cases including: Tinsley v Sarkar [2005] EWHC 192 [QB] - claimant suffered catastrophic brain injuries and Matthew helped to secure his release from Section under the Mental Health Act [1983] and damages of £3.4 million. This is a lead case on the responsibilities of PCTs to continue to pay for a patient's care in the community under section 117 of the act, despite the windfall of a payment of damages by a defendant. Hutchinson v Rudyard - recovered £2.5 million following a settlement before trial. Claimant suffered catastrophic brain injuries and is now living in his own home supported by a team of carers and a case manager. Proctor v Derbyshire CC - recovered £1.5 million following an out-of-court settlement. Claimant suffered paraplegia following a fall from his motorcycle as it approached a dangerous bend in the road where the local authority had not provided the claimant adequate warning. Wheeler v Smith - Recovered almost £1 million in damages for a claimant left a tetraplegic following a rear-end collision. His injuries also left him with a weak heart and tragically he died from his injuries before settlement.
