Woman wins claim after uninsured driver knocked her over

A woman who was knocked over by an uninsured driver has been awarded almost £50,000 in compensation.

The Fentons client was crossing the Doncaster Road in South Yorkshire on the evening of 5 December 2006, when she was struck by a white Renault Mégane.

Michael Durban, who represented the 49-year-old, said the accident happened at around 5.15 pm. "Although it was dark, the street lights were on," he said.

"There is no pedestrian crossing on this particular section of Doncaster Road, so my client looked in both directions - the road is quite straight and visibility was good," he said. "As she could see no traffic, she walked across the road at normal pace."

He said she was just a few steps from the pavement on the far side of the road when she saw the car coming towards her 'from out of nowhere'.

The woman suffered scalp and facial lacerations, a fractured shoulder, a left tibial fracture, a punctured lung, broken ribs and a psychological reaction to the collision.

Although the driver responsible for the incident was uninsured, the car he was driving was insured by his partner. Michael was able to pursue a claim against those insurers, and negotiated a settlement of £47,500 on behalf of his client.
