Victory for family in asbestos compensation battle

The family of a man who died from asbestos-related cancer has won a £122,500 settlement, just weeks after he succumbed to his illness.

Our client was diagnosed with mesothelioma in December 2008, and he immediately realised it had been caused by his exposure to killer asbestos through his work. Although he began the process of claiming compensation, he died less than three months later in March this year.

But our clients' family continued to fight for justice in his memory, and in July agreed the substantial settlement with his former employer, the London Strategic Health Authority.

"Our client worked with asbestos for years," said Lesley Mynett, industrial disease specialist with Fentons Solicitors LLP, representing the family. "He never knew that the job he loved and took so much pride in, would ultimately kill him."

She said the client had worked in the maintenance department of a hospital for 17 years, from 1965 to 1982.

"The nature of his work meant that if he wasn't sawing through asbestos boards to make boxing to cover pipes, he was drilling through them to attach them to walls, or even using asbestos panels to make ironing boards for the nurses," said Ms Mynett. "His exposure to asbestos was constant."

She said that despite his age and ill-health, he continued to look after his disabled wife until he became too sick from the painful cancer to do so. His nephew and niece then took on the responsibility of looking after the couple.

"Our client loved his family, and his fight for compensation was as much about making sure they were able to manage in his absence, as it was about holding his former employers to account," she said. "All he did was go to work, but ultimately that cost him his life."
