Stair fall holidaymaker wins damages claim

An elderly lady who broke her ankle when she fell down the steps to her villa while on holiday has won a claim for compensation.

The 75-year-old, who was staying in Majorca, was left with a black eye and also badly shaken following the incident.

Nicola Simpson, a holiday accident specialist with Fentons Solicitors LLP, represented the woman.

"The steps in question were all constructed from the same colour tiles," said Nicola. "When viewed from above, the steps could not be distinguished from each other. There were no highlights or contrasting edgings to differentiate individual steps, nor was there a handrail. This was clearly an accident waiting to happen."

Nicola said the holidaymaker had been descending the steps when she lost her footing and fell, sustaining the injuries.

"As a result of the accident, our client suffered a broken left ankle and also banged her head resulting in a black eye," said Nicola. "Tour operators have a duty to ensure that holidaymakers' accommodation is safe and that they are not exposed to the risk of injury. We proposed that the situation was made more hazardous because the steps were also irregular in depth and size."

The woman's claim was settled for £7,400.
