Plumberís mesothelioma case settled in just five months

A plumber who developed the asbestos-related cancer mesothelioma through work he did decades ago has received £115,000 in compensation - just five months after contacting lawyers.

Susan Dawson, an industrial disease specialist with Fentons Solicitors LLP, said the settlement would allow the retired man and his wife of more than 50 years to concentrate on his treatment in the coming months.

“My client had trained as a plumber from leaving school, and apart from his two years’ National Service and a brief spell with another firm, he worked with the same building contractor for almost 20 years,” she said. “Between 1950 and the early 1970s, he was exposed to asbestos on numerous occasions which led to him developing mesothelioma.”

Susan said that her client contacted his doctor after he began to suffer breathing difficulties. “He had always been a fit and healthy man, but he began suffering from breathlessness and a wheeze in his chest,” she said. “He went to see his GP and was referred for an x-ray which showed he had fluid on his lungs. A series of tests and consultations led to the shattering diagnosis of mesothelioma.”

Mesothelioma is an incurable lung cancer caused by exposure to asbestos. As soon as he was diagnosed, the retired plumber contacted Susan.

“It was immediately apparent that he had been exposed to asbestos throughout his career with the building contractor,” said Susan. “He was able to explain how he would remove the lagging from pipes to carry out repairs, and cut and drill through asbestos sheets and tiles in order to fit or access pipe work.

”At no stage did his employer provide any kind of protective mask, or warn my client of the dangers of breathing in the deadly asbestos dust,” said Susan.

Although the defendant insurers initially questioned whether the plumber might actually have been exposed to asbestos during self-employment in later years, they admitted liability within two months of Susan taking on the case.

“We were able to quickly secure further witness evidence to prove he was exposed during his time with the company,” said Susan. “This meant that we could set about negotiating a settlement very quickly, and the claim settled in just over five months.

“All my client did was work conscientiously, and he now faces the devastating consequences of being exposed to asbestos,” she said. “This settlement will hopefully enable my client and his wife to spend their time together concentrating on his treatment, without worrying about their financial situation.”
