Pedestrian hit by car loses job after being seriously injured

A man who lost his job after he was seriously injured when he was hit by a car has received more then £140,000 in compensation in an out of court settlement.

Joanna Bailey, a road collision injury specialist with Fentons Solicitors LLP, said the victim had sustained the injuries when he was knocked over while crossing a road near his home in February 2006.

"My client sustained multiple injuries including fractured ribs, a fracture to the left upper tibia, broken teeth and injuries to the chest," said Joanna, a partner with the firm. "The fractured tibia led to a condition known as Compartment Syndrome, where blood pressure in the affected area increases dramatically, which can lead to the blood supply to the damaged muscle being severed. He remained in hospital for ten days undergoing a four-hour operation to have two large metal plates permanently inserted into his leg."

Unable to bear any weight on his left side, the man moved in with a family member who provided care and assistance until he was able to walk unaided again some nine weeks later. Left with permanent weakness, scarring and muscle wastage to his injured leg, the man lost his job.

"My client has been diagnosed with post-traumatic-stress-disorder as a result of the collision," said Joanna. "He suffers from panic attacks and impaired concentration.

"His leg is particularly painful in the morning as well as in the cold or damp weather, and doctors have advised him that he is at risk of developing degenerative arthritis over the next three or four years and will most likely require further surgery, including a total knee replacement," she said.

The driver was subsequently convicted of driving without due care and attention.

In August 2010, Joanna successfully negotiated a gross settlement of £147,058 on behalf of the victim. "After four years of fighting, my client has finally been awarded the financial support he needs to get on with his life," she said.
