Mesothelioma compensation victory for delivery driver

A delivery driver represented by Fentons Solicitors has settled his compensation claim for £110,000, after being exposed to asbestos in the course of his work led to him developing mesothelioma.

In November 2008, the client was diagnosed with the painful cancer caused by exposure to asbestos. Lesley Mynett, an industrial disease specialist with Fentons Solicitors LLP took on the case.

"He was a driver for a two-man haulage firm, making deliveries across the Home Counties," said Lesley. "Unfortunately we were unable to trace the company he worked for, but for around six months he made deliveries for a company which made asbestos products, such as corrugated roofing and gable ends.

"During his deliveries, he would go and collect a shipment, sometimes helping to load the products," she said. "Because of this exposure, we were able to pursue an Occupier's Liability case against this company instead of the employers."

The case was due to go trial in July 2009, but the defendants agreed to settle the claim for £110,000 just days before the hearing was set to begin.

"Our client is married with two grown-up children and a two-year-old granddaughter, and unfortunately his prognosis is not good," said Lesley. "All he did was go to work, and it will ultimately cost him his life."
