Smart -v- Paul Sly Trading As Barber Brothers

Multiple rib fractures, bilateral pulmonary contusions, pleural effusions and adjustment disorder - £267,000.00.

Mr Smart was injured at work whilst trying to make safe some fire extinguishers before disposal. One of the extinguishers exploded and struck Mr Smart in the chest knocking him to the ground and rendering him unconscious. The accident occurred in 2007 and the insurers for the company made an offer at the outset of the claim in the sum of £3000.00. Fentons, with the assistance of a leading Barrister, settled his case for £267,000.00. Mr Smart received compensation which has enabled him to purchase specially adapted equipment in order to improve his quality of life and for private care to be provided to help him around the home. As Mr Smart could not return to his profession as a Class 1 HGV Driver, Mr Smart received loss of earnings for the rest of his working life. Settlement was achieved in less than 2 years after the accident.
