A man who was unable to work for weeks after breaking his arm on holiday has received £8,000 in an out of court settlement.

The self-employed executive hire driver had been holidaying in the Greek resort of Lakitira, on the island of Kos, in the late summer of 2008. Nicola Simpson, a holiday accident specialist with Fentons Solicitors LLP, said that her client had been making his way to a windsurfing lesson when the incident occurred.

"It was around 9 o'clock in the morning and as he walked down the steps leading from the hotel complex towards the beach, he slipped on only the second or third step," said Nicola. "The steps were made from marble and as it had rained overnight they were very slippery.

"My client fell hard onto his right side, fracturing his right arm and severely bruising the right side of his body. He was treated at Municipal Hospital in Greece, and later at his local hospital upon returning to the UK."

As a member of the specialist Travel and International Litigation team, Nicola immediately noted that under local regulations, steps in Greece should have slip resistant strips. "Whilst other steps in the hotel did have the strips, this particular set of steps did not," she said. "We argued that the steps therefore contravened Greek regulations and this was the cause of my client's accident."

Although the resort owners did not admit liability, settlement was reached in the sum of £8,000.

"My client was unable to work for several weeks following his injury, and we were able to use our local knowledge to ensure that those responsible were held to account," said Nicola.
