Damages for pedestrian left seriously injured after collision with car

A pedestrian, who was left seriously injured when he was struck by a car whilst crossing a road, has received £70,000 in damages in an out of court settlement.

The victim, a Surrey man in his 40s, had been waved across the road by a driver who had slowed down to allow him to cross. But as he was half way across, he was struck by another car which was making an overtaking manoeuvre at speed.

Richard Duxbury, a serious injuries expert at Fentons Solicitors, LLP said his client was thrown across the roof of the car and into the air from the impact of the collision.

“My client landed unconscious almost 20 feet away and was incredibly lucky to have survived,” said Richard, a legal executive with the firm. “When he regained consciousness momentarily, his legs and head were covered in blood, he was in excruciating pain all over his body and he was unable to stand.”

The victim was taken by ambulance to hospital where he was treated for a fractured spine and injuries to his legs and head. He was fitted with a back brace and remained in hospital for the next 10 days before being discharged.

“Over the next seven months my client was readmitted to hospital several times owing to the extreme back pain he found himself living with on a daily basis,” said Richard. “In addition, he suffered constant severe stomach pains, vomiting and incontinence and underwent surgery to remove an infected gall-bladder as well as a blood clot on his lung.”

Eight months after the incident, the man was admitted back into intensive care after contracting a bone infection in the discs around his fractured spine. After an operation to insert metal-work into his back to support his damaged vertebrae, he returned home in a wheelchair, entirely reliant on the assistance and care of his friends and family.

“Prior to his injuries, my client was running three miles a day,” said Richard. “Following this accident, it took him two years just to recover sufficiently enough to stand unaided. Now, more than three years after he was hit by the car, he still uses a stick to help him with his balance.

“My client has had to endure what has been a horrific ordeal through no fault of his own,” added Richard. “After the defendant denied liability, court proceedings were issued and although I advised my client to reject the settlement figure the defendant offered as I believed it was too low, my client was keen to settle his claim early and accepted the offer. I hope the settlement will help him now move on with his life.”

Richard settled the claim on behalf of his client for £70,000 in July 2011.
