A young woman who suffered a fractured vertebra during a road accident while holidaying in Spain has received £40,000 in an out of court settlement.

The 26-year-old office worker had been holidaying in Motril on the Spanish Costa Tropical, when she was involved in the collision. She was the passenger in a hire car which collided with another vehicle on a busy dual carriageway.

"Although my client received emergency treatment in Spain, she was still suffering pain in her back when she returned to the UK just a few days after the collision," said Nicola Simpson, a holiday accident specialist with Fentons Solicitors LLP. "Because her injury had been diagnosed as tissue damage by doctors in Spain, her own GP referred her for physiotherapy, but the pain did not go away."

It was only after visiting a chiropractor some four months after the incident that the victim, who was 22 at the time, learned she had fractured a vertebra in her back.

"Although the fracture eventually healed naturally, my client has spent the last four years in continual pain and discomfort," said Nicola. "The injury has affected her work, her social life and even her relationship. This was a truly horrific injury which has had a devastating impact on her life."

Nicola successfully pursued a claim against the hire car company's insurance company, and the young victim received £40,000 in compensation.
