Client awarded more than £150,000 compensation after fatal accident

12th March 2010

A Fentons client agreed a £157,000 settlement following an accident which claimed the life of his son, and left him with a catalogue of injuries.

On 14 January 2005, the client was driving to work with his son, who worked alongside him. The defendant's driver parked his truck in the inside lane of a dual carriageway, on a bend through which visibility was significantly hampered by low-lying sun.

As our client rounded the bend after overtaking a large lorry, he was completely unable to see the parked truck. A high velocity impact took place, and his son was tragically killed.

Our client sustained life-threatening injuries, including a serious spinal injury comprising an unstable, four part fracture of the first cervical vertebra. He suffered severe post-traumatic stress disorder, a frozen shoulder and fractured wrist. His recovery has been slow and very painful, both physically and emotionally. He has been unable to return to his employment, in work he loved doing with his son.

On 19 January 2009, Martin James negotiated a settlement which would see our client receiving £157,250.

The substantial damages awarded take into account the significant loss of earnings suffered and will hopefully help our client to rebuild his life. He is now hoping to be able to return to some form of employment.
