Car passenger suffers fractured neck in collision
A man, who fractured his neck when the vehicle he was a passenger in collided with a stationary car, has received £50,000 in damages.
The man, who was a front-seat passenger at the time of the collision, was taken by ambulance to hospital where he was x-rayed and told he had suffered a fractured neck. He was discharged three days later after a stabilising device used for cervical fractures was fitted to support and prevent any movement of his neck.
Michael Latner, a serious injuries expert at Fentons Solicitors, LLP said: “My client continues to experience ongoing psychological symptoms as well as discomfort and stiffness to his neck and pain around his right shoulder. He can barely turn or tilt his neck to the left and he finds it very hard moving his neck to the right. He cannot sit for any length of time without his neck locking and becoming painful and he is totally unable to lift or carry any kind of significant weight.
Michael explained that following the incident, his client was fitted with what is known as a halo jacket. “It is extremely cumbersome, unsightly and restrictive and is designed to stop all movement of the cervical spine,” he said. “It consists of a metal ring secured to the skull with pins supported by two metal rods which are attached to a rigid plastic jacket worn around the trunk.
“After three months, the device was removed and replaced with a rigid cervical collar,” said Michael, an associate with the firm. “When the fracture was found to have healed the following month, he was fitted with a soft collar and underwent ten months of extensive physiotherapy.”
Michael said that although he believed his client was entitled to a more significant damages settlement, the victim was keen to settle the claim as early as possible and accepted an early offer of £50,000 in July 2011.
“We hope that the damages he has now received will help him put this unfortunate and painful experience behind him,” said Michael.
