£130,000 Mesothelioma claim award for Fentons client

Fentons Solicitors won £130,000 for James McGovern who developed Mesothelioma aged 73 as a result of exposure to asbestos.

Mr McGovern was exposed to asbestos when employed as a labourer for John Mowlem in the early 1970s. He worked on the re-construction of King William Street Bridge, London and was required to strip out the old asbestos corrugated roof sheets that lined the bridge arches.

Liability was initially denied by the Defendants. Fentons Solicitors therefore quickly commenced Court Proceedings and although the Defendants then admitted negligently exposing Mr McGovern to asbestos, they now disputed his need for nursing care. Fentons had no option but to proceed as quickly as possible to trial. No offer of settlement was received form the Defendants until 8 days before trial, which was considered too low and therefore was rejected. The Defendants were not prepared to negotiate further until 2 days before the trial, when Fentons successfully settled the claim.

His Solicitor , Susan Dawson was quoted as saying " the defendants disputed Mr McGovern's need for care throughout the case. This was despite his deteriorating health and the fact his wife aged 70 would be unable to provide the 24 hour care he would ultimately require. The settlement reached on behalf of Mr McGovern ,although it will never be enough to compensate him and his family for this terrible disease caused by the Defendant's negligence, it was a huge relief to him to know that the matter had been successfully concluded without the added stress of having to attend trial at such a difficult time for him and his family"
