Mrs M Blackman from Hampshire sustained a fracture of the left tibia requiring an internal reconstruction plate and suffered an oblique fracture of the upper left fibula which remained ununited. The claimant also underwent split skin grafts, the donor site being the right thigh, and was left with significant scarring.
In addition the claimant suffered an injury to her right knee and fractures of four ribs, along with abrasions to the legs, arms, back and chest.
The court found that the claimant would have a reduced life expectancy of eight and a half years. Liability was apportioned on a eighty / twenty percent basis in the claimants favour.
The claimant continues to require considerable care and has lost much of her pre-accident independence. The central area of dispute in the case related to care evidence.
