LUNG CANCER SUFFERER RECEIVES INTERIM AWARD

13 June 2008

Dominic Graham a solicitor at Fentons Solicitors LLP has secured an interim payment for a 69-year-old man, from Rochester in Kent, in the sum of £50,000 from the Ministry of Defence this week following their admission that they breached their duty of care towards him when he worked as a Boilermaker for more than 30 years at their dockyard in Chatham, Kent.

As a result of his exposure to asbestos during the course of his working life he has now been diagnosed with lung cancer that has unfortunately spread to his brain and the prognosis is not optimistic.

Employees were exposed to asbestos dust whilst working on ships and vessels needing repairs and maintenance at the Chatham Dockyards. Boilermakers, laggers and other tradesmen stripped asbestos from pipes and boilers and caused clouds of asbestos dust to be sent into the work atmosphere. Those working in this atmosphere were forced to breathe in this dust as they worked.

No masks or breathing equipment were ever provided, and no warnings were ever given about the potential dangers that asbestos dust may pose to health later in life.

This claim will now continue and he hopes to obtain a full settlement in the near future.

His solicitor, Dominic Graham of Fentons Solicitors LLP, was quoted saying "A great number of the former employees of the Ministry of Defence were exposed to a large amount of asbestos during the course of their work at the Chatham Dockyards. They were effectively poisoned when they went to work every day. It shouldn't have happened. It is good to see the Defendant in this case, the Ministry of Defence, admitting breach of duty early so that the rightful compensation is received quickly."
