What is Legionnaires Disease?
Legionnaires' disease is a type of pneumonia or lung infection that is caused by a bacterium called Legionella Pheumophila.
Man made systems such as air conditioning units, water fountains, shower heads and whirlpool spas create environments which allow legionella bacteria to increase to large numbers which cause outbreaks of Legionnaires disease.
The infection is caused through breathing in tiny water droplets containing the bacteria and these then enter the lungs.
Symptoms of Legionnaires Disease
· Flu like symptoms of fever and chills.
· Cough
· Abdominal pain.
· Diarrhoea
· Confusion
· Muscle aches
· Headache
· Tiredness
· Loss of appetite
· Delirium
Bringing a legal claim
In order for a holidaymaker to make a claim for personal injury against the hotel or tour operator for legionnaires disease, the source of the infection needs to be established. In most cases the incubation period for legionnaires disease is 2-10 days.
If you booked a package holiday you may be able to bring a claim under the Package Travel Regulations 1992 against the tour operator. This has the advantage of bringing the claim under English law albeit the local standards of care will apply to the case, rather than those imposed by British law.
What should you or a family member do in the event of an outbreak?
· Obtain medical treatment in the resort and on your return to the UK. Ensure that your treating doctor carries out appropriate medical tests for Legionnaires Disease.
· Make a complaint to the tour operator and ensure that a copy of the report is provided to you.
· Take photographs of any visible potential sources of infection such as showerheads or leaking air conditioning systems.
· Take details of any other persons in the hotel complex that is suffering from similar symptoms.
· Never accept compensation payments in the resort as this may prejudice your claim.
· Obtain legal assistance as soon as possible on your return to the UK.
