Jay v MOD November 2007
The Claimant Mr Jay, a Corporal in the Army, was attending a rock climbing course near Benidorm, Spain as part of his employment on 6th March 2003 when another climber dislodged a rock causing it to fall and hit the Claimant.
Mr Jay was fortunately wearing a helmet but sustained a fractured right clavicle and compression fractures to two thoracic vertebrae.
The Claimant left the Army and, although he was able to work, his earning capacity was reduced. His case included a claim for assistance with DIY and gardening.
In October 2007 the case was settled for £260,000.
