Settlement: £135,000 for fractured leg and crushed lung plus the costs of vocational rehabilitation to aid Mr Barry in gaining a new career.
Fentons client Mr Barry was just 17 at the time of the accident. He was a pillion passenger on a motorbike involved in a collision with a car.
He sustained multiple orthopaedic injuries including a fractured leg and crushed left lung. An operation was required for the leg. A frame was used to hold the leg in place. Unfortunatly, the screw site of the frame became infected and a further operation was required.
Mr Barry had ongoing difficulties. The area of the leg where the screws had been inserted became swollen, stiff, and painful. Further future operations are anticipated to prevent bone growing and restricting movement
Mr Barry was a trainee chef at the time of the accident. Given his ongoing problems with standing this was no longer a viable career for him.
He recovered damages in the sum of £135,000 plus the cost of training for a new career. The settlement included damages for future loss of earnings for those periods in his life when anticipated operations would be required, together with the cost of those operations. Further, damages were recovered for the loss of the career as a chef which he had valued and was lost due to the accident.
