CAREHOME WORKER TO RECEIVE £11,000 FOLLOWING A SLIPPING ACCIDENT ON A SPEEDBOAT RIDE AT SCARBOROUGH HARBOUR

30 August 2006

Mrs Brocklehurst and her husband had walked around Scarborough Harbour and decided to go for a boat ride.

At the end of the boat ride, the speedboat moored alongside another speedboat that was positioned next to the jetty.

Mrs Brocklehurst had to climb to the back of the speedboat and onto the empty backseat of the adjacent speedboat which was next to the jetty.

As Mrs Brocklehurst stepped over onto the speedboat her left foot slipped on the wet seat causing her to fall into the foot well of the speedboat and twist her left ankle.

The client has attended Scarborough General Hospital and Rochdale Royal Infirmary and it was confirmed that she had suffered a chronic tear of the lateral ligament in her left ankle.

Mrs Brocklehurst received a course of private physiotherapy treatment arranged by Fentons which consisted of acupuncture, ultra sound, massage, heat treatment and the use of a tens machine for pain relief.

Fentons recovered the cost of her private operation to surgically reconstruct the lateral ligament in her left ankle.

Mrs Brocklehurst said “the compassion and the understanding shown by my solicitor was overwhelming.  My claim was handled professionally and swiftly.”

John Hutchings of Fentons Solicitors represented Mrs Brocklehurst and said “it was a pleasure to recover compensation for Mrs Brocklehurst and obtain the cost of private surgery to help her fully recover. This accident could have been prevented if the Defendant had provided a safe and direct way of disembarking the speedboat onto the jetty.  It is now hoped that others using this boat ride will be provided with a safer way of disembarkation in the future”.
